Also how as a nation that is 75% protestant and only 18% Catholic or Orthodox even have a declaration of heresy? There is no orthodoxy to declare something heterodox. I don't think the author knows what heresy even means.
And then there is the problem that adding an Amendment doesn't get rid of another, so they'd have to repeal the First rather than add a new one. Also there is no separation of Church and State in the US, the Amendment merely stipulates that the state can't establish a Church or abridge free worship, not that religious or anti-religious motives are banned from legislation or public discourse.

combination: Technically the United States does have an official separation of Church and State, dating from the signing of the Treaty of Tripoli. It's just that those exact words are not used.
Regardless, any government that tried to declare a theocracy in the USA would see nationwide riots and would likely see itself torn down within days.
